Account
Setup
We will setup your account after we have received payment and we and/or
our payment partner(s) have screened the order(s) incase of fraud.
It is your responsibility to provide us with an email address which is not @
the domain(s) you are signing up under or will be signed up under

Content
All services provided by ™Simple Shoppes may only be used for lawful
purposes.
This includes, but is not limited to: copyrighted material, material we
judge to be threatening or obscene, pornography, dangerous or unsecured
scripts.
The customer agrees to indemnify and hold harmless ™Simple Shoppes from any
claims resulting from the use of our services.
DOS attacks or any other attacks launched from within our servers or against
our servers may result in your account being terminated.
Determination is at ™Simple Shoppes sole discretion.
™Simple Shoppes reserves the right to charge the holder of the account a
clean-up fee if found to be in violation.
The cost of the clean-up fee is left entirely to the discretion of ™Simple
Shoppes and is due upon receipt.

™Simple Shoppes does not allow Pornography sites.
We will actively work with law enforcement officials to prosecute child
pornography or those found to be breaking the law.
It is your responsibility to adhere to local laws.
Zero Tolerance Spam Policy
™Simple Shoppes takes a zero tolerance stance against sending of
unsolicited e-mail, bulk emailing, and spam.
"Safe lists" and "double opt-in" will be treated as spam.
Any user who sends out spam will have their account terminated without
notice nor refund
™Simple Shoppes
reserves the right to require changes or disable as necessary any web site,
account, database, or other component that does not comply with this policy.
™Simple Shoppes also reserves the right to make any such modifications in an
emergency at our sole discretion.
Payment
Information
You agree to supply appropriate payment for the services received from
™Simple Shoppes
in advance of the time period during which such services are provided.
You agree that until and unless you notify ™Simple Shoppes of your desire to
cancel any or all services received,
those services will be billed on a recurring basis.
All
subscribers will be billed via PayPal and will be sent a payment request.
The payment is due upon receipt of the payment request.
If payment has not been received by ™Simple Shoppes within 5 days from the
date of the payment request is issued
the subscribers account(s) and or any pending account(s) will be suspended. If
payment in full is not made within a 10 days timeframe from date of suspension
of said site - account will be terminated.
Money Orders:
Subscribers
who choose to be billed by mail will receive an invoice via the USPS.
The payment is due upon receipt of said invoice.
If payment has not been received by ™Simple Shoppes within 15 business days
of mailing invoice the subscribers account(s) and or any pending account(s)
will be suspended and/or not set up.
Backups and Data Loss
Your use of our services is at your sole risk.
™Simple Shoppes is not responsible for files and data residing on your
account.
You agree to take full responsibility for files and data transferred
and to maintain all appropriate backup of files and data stored with ™Simple
Shoppes.
Cancellation
and Refunds
™Simple Shoppes reserves the right to cancel the account at any time.
Customers may
cancel at any time by giving written notice (electronic mail from the email
account you signed up with or postal mail) 30 days from anticipated
cancellation date.
If
canceling service without required 30 day notice, we reserve the right to
charge a fee for services rendered such as removal of account, transfer of
domain (if applicable) and any licensing fees that may occur.
Due to the Nature of this Business ™Simple Shoppes can only give you an
unconditional 24 hr Money Back Guarantee on our Services
Refund requests after 24 hrs will be null and void and will not be issued.
Your purchase - may it be Graphics and/or Custom Design(s) - from
SimpleShoppes™ indicates your acceptance of this policy.
We reserve
the right to refuse a refund if we find that you used your account against our
Terms of Service/Acceptable Usage Policy.
If
canceling service within the first Day, we reserve the right to charge a fee
for services rendered such as
set up and removal of account and any licensing fees that may occur
Set up Fees
are NON-refundable !
If you hire
us to custom design your Website a 50% downpayment is expected before we
begin.
Bandwidth Usage
You are allocated a monthly bandwidth allowance.
Should your account pass the allocated amount we reserve the right to suspend
the account until the start of the next allocation, suspend the account until
more bandwidth is purchased at an additional fee, suspend the account until
you upgrade to a higher level of package,
terminate the account and/or charge you an additional fee for the additional
bandwidth used.
Unused transfer in one month cannot be carried over to the next month.
Support
™Simple Shoppes offers support via Email,Phone or IM (Instant Messenger)
We will offer telephone support only after a request via email has been
issued by you.
Abuse
of our Support Staff will not be tolerated.
Our staff will always respond in a courteous and respectful manner.
We ask that you do the same.
We reserve the right to suspend or terminate your account if we find you to
be abusive to our staff.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold ™Simple
Shoppes harmless from any and all demands, liabilities, losses, costs and
claims, including reasonable attorney's fees asserted against ™Simple
Shoppes, its agents, its customers, officers and employees, that may arise
or result from any service provided or performed or agreed to be performed
or any product sold by customer, its agents, employees or assigns.
Customer agrees to defend, indemnify and hold harmless ™Simple Shoppes
against liabilities arising out of;
(1) any injury to person or property caused by any products sold or
otherwise distributed in connection with™Simple Shoppes
(2) any material supplied by customer infringing or allegedly infringing on
the proprietary rights of a third party;
(3) copyright infringement and
(4) any defective products sold to customers from ™Simple Shoppes.
Disclaimer
™Simple Shoppes will not be responsible for any damages your business
may suffer.
™Simple Shoppes makes no warranties of any kind, expressed or implied for
services we provide.
™Simple Shoppes disclaims any warranty or merchantability or fitness for a
particular purpose.
This includes loss of data resulting from delays, no deliveries, wrong
delivery,
and any and all service interruptions caused by ™Simple Shoppes and/or its
employees or partners.
™Simple Shoppes reserves the right to refuse service to anyone.
We reserve the right to limit what scripts and software is uploaded to our
server.
Changes to the Terms of Service & AUP
™Simple Shoppes reserves the right to revise its policies at any time
without notice simply by posting the revised terms on this web page.
